Welcome to Enthusiast Exotics. These Terms and Conditions ("Terms") govern your use of our car rental services and website. By renting a vehicle from us, you agree to be bound by these Terms. Please read them carefully.

1. Definitions

  • "Company," "we," "us," or "our" refers to Enthusiast Exotics
  • "Renter," "you," or "your" refers to the individual renting the vehicle
  • "Vehicle" refers to the car rented from Enthusiast Exotics
  • "Rental Agreement" refers to the contract between you and Enthusiast Exotics for vehicle rental
  • "Rental Period" refers to the agreed-upon time during which you may use the Vehicle

2. Eligibility and Requirements

2.1 Age Requirements

  • Renters must be at least 18 years of age
  • All drivers must meet our minimum age requirements and provide valid documentation

2.2 License Requirements

  • Valid driver's license held for a minimum of 2 years
  • License must be in good standing with no major violations

2.3 Insurance Requirements

  • Proof of personal auto insurance with full coverage limits
  • Insurance must cover luxury/exotic vehicle rentals
  • Alternate insurance options may be available upon request

3. Reservations and Bookings

3.1 Booking Process

  • Reservations may be made online, by phone, or via SMS
  • A valid credit or debit card is required to secure your reservation
  • We collect driver's license, insurance, and payment information solely for the purpose of processing your rental

3.2 SMS Communications

  • We use SMS texting exclusively for booking confirmations, reminders, and rental-related communications
  • We do not use SMS for marketing purposes
  • You may opt out of SMS communications at any time by replying STOP

3.3 Payment and Deposits

  • A security deposit is required at the time of vehicle pickup
  • The deposit amount varies by vehicle and will be disclosed at booking
  • Full payment is due at the start of the rental period unless otherwise arranged
  • We accept major credit cards and debit cards

4. Data Collection and Privacy

4.1 Information We Collect

We collect the following information solely for the purpose of renting a vehicle to you:

  • Driver's license information
  • Insurance policy details
  • Credit/debit card information
  • Contact information (phone number, email, address)

4.2 Data Storage and Security

  • All customer data is stored securely offsite using Digital Ocean infrastructure
  • We implement industry-standard security measures to protect your information
  • Your data is encrypted both in transit and at rest
  • We retain your information only as long as necessary for rental purposes and legal requirements

4.3 Data Use

  • Your information is used exclusively for processing and managing your vehicle rental
  • We do not sell, share, or use your data for marketing purposes

5. Vehicle Use and Restrictions

5.1 Authorized Use

You agree to use the Vehicle only for lawful purposes and in accordance with these Terms. The Vehicle may only be driven by:

  • The named renter on the Rental Agreement
  • Additional drivers approved and listed on the Rental Agreement

5.2 Prohibited Uses

You agree NOT to use the Vehicle for:

  • Racing, speed contests, or performance testing
  • Towing or pushing anything
  • Transportation of passengers or property for hire
  • Any illegal activity or purpose
  • Off-road driving or on unpaved roads
  • Driver instruction or training
  • Subletting or re-renting
  • Transportation of hazardous materials
  • Use while under the influence of alcohol, drugs, or medication that impairs driving ability

5.3 Geographic Restrictions

  • The Vehicle must remain within the Tampa Bay Area unless prior written approval is obtained
  • Specific routes or areas may be restricted based on vehicle type

6. Vehicle Condition and Inspection

6.1 Pre-Rental Inspection

  • You will inspect the Vehicle with our representative before departure
  • Any existing damage will be documented on the rental agreement
  • You are responsible for noting all pre-existing damage

6.2 Your Responsibilities

  • Maintain proper fluid levels (oil, coolant, windshield washer)
  • Keep tires properly inflated
  • Return the Vehicle in the same condition as received, normal wear excepted
  • Report any mechanical issues or damage immediately

7. Fuel Policy

  • Vehicles are provided with a full tank of premium fuel
  • You must return the Vehicle with a full tank of the same grade fuel
  • If returned without a full tank, you will be charged a refueling fee plus the cost of fuel at a premium rate
  • Use only the recommended fuel grade for the specific vehicle (typically premium/high-octane)

8. Insurance and Liability

8.1 Insurance Coverage

  • You are responsible for maintaining adequate insurance coverage throughout the rental period
  • Your insurance is primary in the event of any damage or loss
  • Minimum coverage requirements will be verified before rental

8.2 Your Financial Responsibility

You are financially responsible for:

  • All damage to the Vehicle, regardless of fault, up to the full value of the Vehicle
  • Loss of use charges while the Vehicle is being repaired
  • Diminished value of the Vehicle if applicable
  • All towing and recovery charges
  • Traffic violations, parking tickets, toll violations, and related fines
  • Administrative fees for processing violations and claims

8.3 Damage Waiver Options

  • Optional damage waiver coverage may be available for an additional daily fee
  • Coverage details and exclusions will be provided upon request

9. Accidents and Damage

9.1 In Case of Accident

If the Vehicle is involved in an accident, you must:

  • Contact local police and file an accident report
  • Notify us immediately by phone
  • Obtain contact and insurance information from all parties involved
  • Take photographs of all damage and the accident scene
  • NOT admit fault or liability
  • Complete our accident report form

9.2 Theft or Vandalism

  • Report immediately to police and obtain a report number
  • Notify us within 24 hours
  • Provide all keys and documentation

10. Breakdown and Mechanical Issues

  • Contact us immediately if the Vehicle breaks down or shows warning lights
  • Do not attempt repairs without our authorization
  • We will arrange for roadside assistance or replacement vehicle when necessary
  • You are not responsible for mechanical failures due to normal use
  • You are responsible for damage caused by misuse, negligence, or failure to maintain proper fluid levels

11. Rental Period and Returns

11.1 Rental Duration

  • The rental period begins and ends at the times specified in your Rental Agreement
  • Hourly, daily, and weekly rates are available
  • Each "day" is a 24-hour period from the time of pickup

11.2 Extensions

  • Extensions must be requested and approved before the original return time
  • Extensions are subject to vehicle availability
  • Additional charges will apply at the agreed-upon rate

11.3 Late Returns

  • A grace period of 30 minutes is provided
  • After the grace period, late fees will apply
  • Unauthorized late returns may result in additional penalties
  • If the Vehicle is not returned within 24 hours of the scheduled return time without prior authorization, it may be reported as stolen

11.4 Return Procedure

  • Return the Vehicle to the agreed-upon location
  • A final inspection will be conducted
  • Return all keys, documents, and accessories
  • Settle any outstanding charges

12. Cancellations and Modifications

12.1 Cancellation by Renter

  • Cancellations made 72+ hours before pickup: Full refund of deposit
  • Cancellations made 48-72 hours before pickup: 50% deposit refund
  • Cancellations made less than 48 hours before pickup: No refund
  • No-shows: No refund and potential liability for the full rental period

12.2 Modifications

  • Changes to reservations are subject to availability
  • Rate changes may apply based on new rental dates
  • Modification fees may apply for changes made within 48 hours of pickup

12.3 Cancellation by Company

  • We reserve the right to cancel any reservation due to vehicle unavailability, maintenance issues, or other circumstances
  • In such cases, we will provide a full refund or offer a comparable vehicle

13. Pricing and Fees

13.1 Rental Rates

  • Rates are based on the vehicle selected and rental duration
  • Rates are subject to change and are locked in at the time of confirmed booking
  • All rates are quoted in US Dollars

13.2 Additional Fees

Additional fees may include but are not limited to:

  • Additional driver fees
  • Young driver surcharges (if applicable)
  • Optional insurance/damage waiver
  • Delivery and pickup fees
  • Airport fees or surcharges
  • Cleaning fees for excessive dirt or odors
  • Smoking fee
  • Pet fee (if unauthorized)
  • Refueling charges
  • Toll and parking violation processing fees

13.3 Security Deposit

  • A security deposit is held on your credit card during the rental period
  • The deposit will be released 7-14 business days after vehicle return, subject to final inspection and resolution of any claims
Important: The security deposit may be used to cover damages, late fees, traffic violations, cleaning fees, or other charges incurred during your rental.

14. Cleaning and Smoking Policy

  • All vehicles are non-smoking
  • Smoking in the Vehicle will result in a minimum $500 cleaning fee
  • Return the Vehicle in reasonably clean condition
  • Excessive dirt, stains, or odors will result in cleaning fees
  • Pets are not permitted unless specifically authorized in advance

15. Roadside Assistance and Support

  • 24/7 roadside assistance is provided for mechanical breakdowns
  • Contact information will be provided at the time of rental
  • Services include towing, tire changes, jump starts, and lockout assistance
  • You are responsible for damages resulting from lack of maintenance or misuse

16. Traffic Violations and Toll Charges

  • You are responsible for all traffic violations incurred during the rental period
  • You are responsible for all toll charges and violations
  • We will forward all citations to you and may charge an administrative fee for processing
  • Your credit card may be charged for unpaid tolls, violations, and administrative fees

17. Indemnification

You agree to indemnify, defend, and hold harmless Enthusiast Exotics, its owners, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:

  • Your use of the Vehicle
  • Your breach of these Terms
  • Your violation of any laws or regulations
  • Any damage to or loss of the Vehicle
  • Personal injury or property damage caused by your operation of the Vehicle

18. Limitation of Liability

  • We are not responsible for personal belongings left in the Vehicle
  • We are not liable for any indirect, incidental, or consequential damages
  • Our liability is limited to the amount paid for the rental
  • We do not guarantee that the Vehicle will be available at the reserved time
  • We are not responsible for delays, inconveniences, or costs resulting from mechanical breakdowns or other issues

19. Dispute Resolution

19.1 Governing Law

These Terms are governed by the laws of the state in which the rental originates, without regard to conflict of law principles.

19.2 Arbitration

  • Any disputes arising from these Terms or your rental will be resolved through binding arbitration
  • Arbitration will be conducted in accordance with the American Arbitration Association rules
  • Each party will bear its own costs and fees

19.3 Class Action Waiver

You agree to resolve disputes on an individual basis and waive any right to participate in class action lawsuits.

20. Special Provisions for Exotic and Luxury Vehicles

Important Notice: Our fleet consists of high-performance exotic and luxury vehicles requiring special care and expertise.

20.1 Driver Experience

  • Renters should have experience operating high-performance vehicles
  • We may require a driving assessment for certain vehicles
  • Vehicles with manual transmissions require demonstrated proficiency

20.2 Performance Driving

  • While our vehicles are capable of high performance, all traffic laws must be obeyed
  • Excessive speeding, racing, or reckless driving will result in immediate termination of the rental
  • Track use is strictly prohibited unless specifically authorized

20.3 Mechanical Sympathy

  • Proper warm-up and cool-down procedures should be followed
  • Avoid excessive acceleration from cold starts
  • Respect engine and transmission temperature warnings
  • Do not exceed posted speed limits or engine redlines

21. Personal Information and Communications

21.1 Contact Information

  • You must provide accurate and current contact information
  • You must notify us immediately of any changes to your contact information
  • We may use your contact information to reach you regarding your rental

21.2 Electronic Communications

  • By providing your email and phone number, you consent to receive communications regarding your rental
  • Communications may include booking confirmations, reminders, and important notices
  • You may opt out of non-essential communications at any time

22. Force Majeure

We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters
  • Acts of war or terrorism
  • Government restrictions
  • Labor disputes
  • Public health emergencies

23. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

24. Entire Agreement

These Terms, together with your Rental Agreement and our Privacy Policy, constitute the entire agreement between you and Enthusiast Exotics regarding your vehicle rental. Any modifications must be made in writing and signed by both parties.

25. Changes to Terms

  • We reserve the right to modify these Terms at any time
  • Changes will be posted on our website with the updated date
  • Your continued use of our services after changes are posted constitutes acceptance of the modified Terms
  • Material changes will be communicated to customers with active reservations
